What is the process of Property Registration?

  1. The documents of property which are required to be registered shall be presented at the office of the Sub-Registrar in whose sub-district the whole or some portion of the property to which they relate is situate.
  2. The seller and the buyer, who are authorised signatories, should be physically present with two witnesses to get the documents registered. (Signatories must bring their identification with them.) Such documents as may be accepted by the Trust include Aadhaar Card, PAN Card or any other document(s) indicating an identity that is certified by a government authority.
  3. The signatories also need to submit a power of attorney if third party is representing.
  4. If it is a company that is party to the agreement, the person executing documents shall carry sufficient authority, such as a POA/Letter of Authority and a copy of the resolution of the board authorising him to do so for registration.
  5. Here, you will have to carry the property card with the original records and proof of payment of stamp duty. The sub-registrar will also check whether the stamp duty has been paid for the property, as per ready reckoner. If there is a shortage of stamp duty, then the registrar will not register the documents.
  6. Stamp duty is the tax that you pay to your government for acquiring a legal right to an asset, and registration charge i,s on the other hand, the amount you are required to comply with in order to get this formality accomplished in the records of the government. Stamp duty differs between each state.
  7. In a majority of the states, women are entitled to rebates or exemptions on stamp duty payments. Now we will have to recall those witnesses, and they are very important here in the whole process.
  8. The two witnesses you propose to bring during the registration will also have to prove their identity before the sub-registrar. For this, they will need to bring their ID proofs along with the address proof. Their biometric identity will also be confirmed by scanning it during the operation.
